I. Purpose

This policy regulates the installation, operation, maintenance, and use of video and audio recording equipment, including personal devices, at Western Nevada College (WNC).

Western Nevada College is committed to fostering an environment that supports the free exchange of ideas and the freedom of action characteristic of institutions of higher learning. Simultaneously, WNC prioritizes the safety and security of individuals who visit, work, or study on its campuses. The use of audio or video equipment on campus must respect the privacy of faculty, staff, students, and visitors in their personal and professional activities.

II. Scope

This policy applies to all personnel, schools, and departments of WNC in their use of video cameras and/or audio recording equipment on college-owned, leased, or controlled properties. Academic research projects using audio and video technology are excluded from this policy.

This policy covers the use of video cameras, including, but not limited to, closed-circuit television (CCTV), networked cameras, and related imaging technologies installed in public spaces, either indoors or outdoors. It also includes all installed audio recording and remote audio monitoring equipment.

III. Surreptitious Recording Prohibited; Exceptions

The use of covert electronic surveillance cameras on the WNC campus is governed by Nevada Revised Statutes (NRS) 396.970, "Surreptitious electronic surveillance on campus; exceptions," which states:

  1. Except as otherwise provided in subsection 2, it is unlawful for a person to engage in any kind of surreptitious electronic surveillance on a campus of the System without the knowledge of the person being observed.
  2. Subsection 1 does not apply to any electronic surveillance:

- Authorized by a court order issued to a public officer, based upon a showing of probable cause to believe that criminal activity is occurring on the property under surveillance;

- By a law enforcement agency pursuant to a criminal investigation;

- Necessary as part of a system of security used to protect and ensure the safety of persons on the campus; or

- Of a class or laboratory when authorized by the instructor.

"Electronic surveillance" includes video, audio/video, and audio-only recordings made via installed or portable recording devices, such as handheld recorders, cell phones, smartphones, tablets, or other electronic devices. Unless one of the stated exceptions applies, individuals are precluded from recording in-person conversations on the WNC campus without the knowledge of all individuals being recorded.

IV. Recording Classes, Lectures, and Meetings

  1. Classes, lectures, and labs may be videotaped or audio recorded only with the written permission of the instructor. Students with disabilities who require recording accommodations must present an Instructor Letter from the Disability Resource Center (DRC). Instructors should not disclose the identity of students recording classes under an accommodation.
  2. Anyone wishing to record a meeting must notify all attendees that the meeting is being recorded.
  3. Formal procedures mandated by NSHE, NAC, or WNC policies that require recording must comply with the notification requirements of this policy.

V. Installed Recording Equipment

This section governs the installation and use of overt surveillance equipment. The policy does not restrict the use of:

- Portable video cameras for personal purposes, such as handheld devices, cell phones, and webcams for video conferencing;

- College-deployed video cameras used expressly to record public special events on campus;

- Audio recording equipment for academic research or by campus security in the normal course of duties.

Objectives for Installed Equipment:

  1. Enhance public safety and security while minimizing costs associated with campus security.
  2. Aid instruction, facilitate remote delivery, and enable video conferencing.
  3. Prevent, deter, or address criminal activity and support law enforcement efforts.

VI. General Principles

  1. Audio recording or monitoring equipment is not to be installed in public or private spaces to monitor private conversations. The only exception is in the case of criminal investigations.
  2. Video security cameras are prohibited in private spaces such as offices, residence hall rooms, and restrooms. Cameras must not view into private areas through windows or other means.
  3. Video equipment in instructional spaces must only be used for instructional purposes and turned off when not in use.
  4. Video surveillance in public spaces must comply with WNC policies, NSHE Code, and state laws. Recordings must be securely stored and managed by Facilities Services.
  5. Information obtained through video surveillance can only be released with the approval of the WNC President or their designee.
  6. Recorded video images must not be retained for more than 30 days unless needed for legal or disciplinary proceedings.
  7. Unauthorized tampering with or disabling of video equipment is subject to disciplinary action.

VII. Responsibilities

  1. Information Technology, Facilities, Campus Police: Information Technology, Facilities Services, in collaboration with Campus Police, are responsible for managing video surveillance installations.
  2. Review Committee: The WNC President will appoint a Video Surveillance Committee (VSC) to review and approve requests for camera installations.

- Members will include representatives from campus departments, faculty, and student bodies.

- The committee will meet at least biannually to review requests and evaluate ongoing surveillance practices.

  1. Compliance Monitoring: Information Security must maintain an inventory of all authorized surveillance equipment and report updates to the President annually.

VIII. Procedures

  1. Requests for the installation or removal of surveillance equipment must be submitted to the VSC for review.
  2. Emergency installations may be provisionally authorized by Campus Police and the College President, with subsequent review by the VSC.
  3. Appeals regarding camera installations can be submitted to the VSC. Final decisions will be made by the College President.
  4. Complaints about camera locations or policy violations will be reviewed by the VSC, which will make recommendations to the appropriate administrative office.

Signage Requirement: Public areas with video surveillance must display signage stating: “This area is subject to video Recording. For more information, contact Campus Security.” Covert cameras authorized under are exempt from this requirement.
